An arrest warrant is a written order authorizing law enforcement to take the person it identifies into custody for an alleged offense. A judge or magistrate issues the warrant, which must identify the person or provide a sufficiently definite description and name the alleged offense.
A warrant directs law enforcement to make an arrest. Texas law requires a magistrate’s signature. If you believe a warrant is defective, an attorney can examine it and evaluate a challenge; a defect does not automatically mean the criminal charge will be dismissed. When making an arrest under a warrant, officers must explain their authority and the reason for the arrest as required by law.
